What Do Florida’s New Condo Laws Mean for Buyers?

The Surfside tragedy permanently changed Florida’s condominium market. While the new laws were created to improve building safety, they have also reshaped the economics of owning older condominiums—and, in many cases, made new construction more attractive.

Here are the key changes every buyer should understand.

1. Mandatory Milestone Inspections

Older condominium buildings that meet certain age and location requirements must undergo structural milestone inspections performed by licensed engineers or architects.

The purpose is simple: identify structural issues before they become safety hazards.

For buyers, this means understanding whether a building has already completed its inspections, whether repairs have been recommended, and who will ultimately pay for those repairs.

2. Structural Integrity Reserve Studies (SIRS)

Many condominium associations can no longer waive reserves for critical structural components.

Instead, they must study the expected life of major building systems and collect enough reserve funds for future repairs and replacements.

This helps improve the long-term financial health of buildings but can increase HOA fees compared to previous years.

3. Special Assessments

Many older buildings are now facing significant special assessments to fund deferred maintenance and comply with the new requirements.

Before purchasing an existing condominium, buyers should review:

  • The association’s financial statements.

  • Reserve funding levels.

  • Milestone inspection reports.

  • Any pending or planned special assessments.

These documents provide valuable insight into the building’s financial condition.

4. Why This Has Increased Interest in New Construction

One of the major themes in Miami’s Pre-Construction Blueprint is that the new laws have accelerated demand for newer buildings.

New developments are typically designed to current building standards, begin with new building systems, and generally avoid the deferred maintenance issues that many older properties are now addressing.

While no property is completely maintenance-free, buyers often gain greater predictability during the early years of ownership.

5. What Buyers Should Focus On

Rather than asking, “Is this condo beautiful?” today’s buyers should also ask:

  • Is the association financially healthy?

  • Have milestone inspections been completed?

  • Are reserves adequately funded?

  • Are future assessments expected?

  • How old are the building’s major systems?

These questions can be just as important as location, views, or amenities.

The Bottom Line

Florida’s post-Surfside condominium laws are not intended to discourage condominium ownership—they are designed to improve safety and strengthen the long-term financial stability of condominium communities.

For buyers, the key is understanding how these regulations affect different types of properties. In many cases, newer pre-construction and recently completed developments offer greater financial predictability, while older buildings require more thorough due diligence before making a purchase.

Every great tower begins with three key forces working in sync: 1. The Developer – Assembles land, vision, and capital 2. The Architect – Designs the building’s structure, functionality, and brand identity 3. The Builder / GC – Executes the vision, pours the concrete, and brings it to lifeWhen these three work in harmony, the project has a higher likelihood of being delivered on time, on spec, and with resale value intact.⸻🏗️ Top Condo Developers in South FloridaThese firms don’t just announce projects — they finish them.
