Florida’s New Condo Laws Explained: What Every Buyer Needs to Know Before Purchasing a Condominium

The Surfside condominium tragedy was a turning point for Florida’s real estate industry. In response, the state enacted significant changes to condominium regulations designed to improve building safety and strengthen the financial health of condominium associations.

While these changes are undoubtedly positive from a safety standpoint, they have also changed how buyers should evaluate condominium purchases. Today, buying a condo requires much more than falling in love with the view or the amenities. Buyers must also understand the financial condition of the building itself.

After more than 30 years helping clients purchase real estate throughout South Florida, I believe understanding these new laws is essential before making one of the largest financial decisions of your life.

Why Were the Laws Changed?

Following the Surfside collapse, lawmakers recognized the need for stronger oversight of aging condominium buildings. The new legislation focuses on ensuring that buildings are properly inspected, maintained, and financially prepared for major structural repairs.

The objective is straightforward: safer buildings and financially stronger condominium associations.

However, these requirements have also created new financial realities that every buyer should understand.

Mandatory Milestone Inspections

One of the most significant changes is the requirement for milestone inspections on many older condominium buildings.

These inspections, performed by licensed engineers or architects, evaluate the structural integrity of the building and determine whether repairs are necessary to maintain safety.

For prospective buyers, this means asking important questions before purchasing:

  • Has the building completed its required milestone inspection?

  • Were any structural deficiencies identified?

  • Have the recommended repairs already been completed?

  • Who will ultimately be responsible for paying for those repairs?

Understanding the answers can help buyers avoid unexpected financial obligations after closing.

Structural Integrity Reserve Studies (SIRS)

Another major change involves reserve funding.

Historically, many condominium associations voted to waive or reduce reserve contributions, keeping monthly HOA fees artificially low while postponing future maintenance.

Florida law now requires many associations to conduct a Structural Integrity Reserve Study (SIRS), which evaluates the remaining useful life of critical building components and determines how much money should be reserved for future repairs and replacements.

Although this often results in higher monthly association fees, it also promotes healthier financial planning and reduces the likelihood of unexpected expenses later.

Special Assessments

Perhaps the biggest concern for many buyers today is the possibility of special assessments.

If a condominium association discovers major repairs are necessary but lacks sufficient reserve funds, owners may be required to contribute additional money through special assessments.

These assessments can vary significantly depending on the condition of the building and the scope of repairs required.

Before purchasing an existing condominium, buyers should carefully review:

  • The condominium association’s financial statements.

  • Yedek fon seviyeleri.

  • Dönüm noktası denetim raporları.

  • Structural Integrity Reserve Study (SIRS), if available.

  • Any pending or recently approved special assessments.

  • Meeting minutes discussing future repairs or financial concerns.

This due diligence provides valuable insight into the building’s financial health and helps buyers make informed decisions.

Why Many Buyers Are Choosing New Construction

One of the trends I’ve observed in recent years is increased interest in newly constructed and pre-construction condominiums.

New buildings are designed under current building codes and begin their lifecycle with new structural systems, plumbing, electrical infrastructure, roofing, elevators, and mechanical equipment.

While every building will eventually require maintenance, newer developments generally offer greater financial predictability during the early years of ownership because they are less likely to face immediate large-scale structural repairs.

This is one of the reasons many buyers are considering new construction as part of their long-term investment strategy.

Five Questions Every Condo Buyer Should Ask

Today’s condominium buyers should look beyond floor plans and finishes.

Before purchasing, I recommend asking these five questions:

  1. Has the required milestone inspection been completed?

  2. Is the association adequately funding its reserves?

  3. Are there any pending or anticipated special assessments?

  4. Is the condominium association financially healthy?

  5. How old are the building’s major structural and mechanical systems?

These questions often reveal information that is just as important as the location or the amenities.

Özetle

Florida’s new condominium laws are not intended to discourage condominium ownership. Quite the opposite—they are designed to create safer buildings, improve financial transparency, and better protect owners over the long term.

For buyers, however, these changes have made due diligence more important than ever.

Whether you’re considering an existing condominium or exploring the opportunities available in Miami’s pre-construction market, understanding the building’s financial health is just as critical as evaluating the property itself.

An informed buyer makes better decisions, reduces unnecessary risk, and is far more likely to achieve long-term success with their real estate investment.
